Terms and Conditions for mVAS

1. General Overview & Applicability

These Terms and Conditions (“Terms”) govern the access to and use of all Mobile Value-Added Services (“mVAS”) facilitated, operated, or provided by EFutureTech Systems (Pvt) Ltd (“EFutureTech”, “Company”, “We”, “Us”) in partnership with third-party content providers (“Partners”) across all telecommunications network operators in Sri Lanka, including Dialog Axiata PLC, Sri Lanka Telecom Mobitel, Airtel Lanka, and Hutchison Telecommunications Lanka (Hutch).

By subscribing to, accessing, or using any mVAS service deployed through EFutureTech—regardless of the service’s specific name, delivery mechanism (SMS, USSD, Web/WAP, App, IVR), billing model, or promotional nature—you (“User”, “Subscriber”) agree to be bound by these Terms.

2. Service Subscription and Opt-in

  • Consent: Subscriptions are activated only upon explicitly completing the required double opt-in or carrier-mandated authorization process (e.g., PIN verification, OTP, or USSD confirmation).
  • Scope: These Terms apply universally to any current or future mVAS service launched via EFutureTech, irrespective of whether it is a daily, weekly, or monthly auto-renewable subscription, or a one-time pay-per-use service.

3. Charges, Billing, and Deduction

  • Mobile Billing: All applicable service charges will be billed directly to the Subscriber’s prepaid mobile balance or post-paid bill via the respective operator (Dialog, Mobitel, Airtel, or Hutch).
  • Pricing Variability: Tariffs, renewal frequencies, and grace periods vary by specific service and operator. Exact pricing is disclosed at the point of subscription/opt-in.
  • Non-refundable: All charges deducted by the telecommunications operator for mVAS rendered are non-refundable, except in verified cases of technical error directly attributable to EFutureTech.

4. Cancellation and Opt-Out

  • Deactivation: Subscribers can opt-out or unsubscribe from any active service at any time using the designated SMS keyword (e.g., replying STOP or UNSUB [Keyword] to the service shortcode), via the service web portal, or through USSD menus.
  • Effect: Deactivation stops future billing cycles immediately; access to premium content or features will terminate upon the expiry of the current paid billing period.

5. Intellectual Property and Content Rights

  • Exclusive Ownership: All content, software, audio, video, graphics, trademarks, logos, texts, and underlying technology used in connection with any mVAS belong exclusively to EFutureTech Systems (Pvt) Ltd and/or its licensors and Partners.
  • User License: Subscribers are granted a limited, non-exclusive, non-transferable, revocable license to view or use the content solely for personal, non-commercial purposes.
  • Restrictions: Copying, modifying, redistributing, broadcasting, reverse engineering, or commercially exploiting any mVAS content without prior written consent from EFutureTech is strictly prohibited.

6. Service Availability and Modifications

  • Network Dependence: Delivery of mVAS depends on the connectivity and performance of the respective telecommunications operators (Dialog, Mobitel, Airtel, Hutch). EFutureTech is not responsible for service delivery delays or interruptions caused by operator network outages or handset incompatibilities.
  • Right to Modify: EFutureTech reserves the right to modify, suspend, or discontinue any mVAS or alter these Terms at any time without prior notice. Continued use of the service constitutes acceptance of any revised Terms.

7. Limitation of Liability & Indemnity

  • As-Is Basis: All services are provided on an “as is” and “as available” basis without warranties of any kind.
  • Liability Cap: EFutureTech, its directors, and its Partners shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the mVAS.
  • Indemnification: You agree to indemnify EFutureTech against any claims, losses, or legal costs arising from your misuse of the services or violation of these Terms.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
